1. Agreement to Terms
Welcome to Abhashri Gems (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website https://abhashrigem.com (the “Site”) and the purchase of precious gemstones (“Products”) from us.
By accessing our Site or placing an order, you, the buyer (“you,” “your,” “Client”), agree to be bound by these Terms. If you do not agree with all of these Terms, you are prohibited from using our services. This agreement is entered into between you and Abhashri Gems, a company registered in Mumbai, Maharashtra, India.
2. Products and Pricing
- Product Representation: We make every effort to display the colours, features, and details of our Products as accurately as possible, using high-resolution photography and videography. However, due to natural variations in colours of gemstones and differences in settings of monitor displays, we cannot guarantee that the colour of Product you receive will be an exact match to what you see on your screen.
- Pricing: All prices are quoted in United States Dollars (USD) unless otherwise specified. Prices are exclusive of any applicable taxes, duties, and shipping costs, which will be added to the final invoice. We reserve the right to change our prices at any time without prior notice.
- Availability: All orders are subject to product availability. We reserve the right to discontinue any Product at any time for any reason.
3. Ordering and Inquiry Process
- Inquiry: Placing a product in a cart or submitting an inquiry does not constitute a confirmed order.
- Quotation: Upon receiving your inquiry, we will provide a formal quotation detailing the Product specifications, price, shipping costs, insurance, and estimated delivery timeline.
- Order Confirmation: An order is considered confirmed only after you have formally accepted our quotation and we have received the agreed-upon advance payment.
4. Payment Terms
- Payment Method: All payments must be made via Bank Wire Transfer (TT) to the official company bank account detailed on our invoice. We do not accept credit card payments for wholesale export orders unless specified otherwise.
- Payment Schedule:
- A non-refundable advance payment of [e.g., 50%] of the total invoice value is required to confirm the order and reserve the Product.
- The remaining balance of [e.g., 50%] is due prior to shipment.
- Title of Goods: The title and ownership of the Products will not pass to the Client until full payment has been received by us.
5. Shipping and Delivery
- Global Shipping: We ship worldwide using trusted, secure logistics partners (e.g., FedEx, DHL, Brinks).
- Shipping Costs & Insurance: All shipping, handling, and insurance costs are the responsibility of the Client and will be itemized on the final invoice. All shipments are fully insured for their value until the point of delivery.
- Delivery Time: Estimated delivery times are provided in our quotation but are not guaranteed. We are not liable for any delays caused by the shipping carrier or customs clearance processes.
- Delivery Address: We will ship to the address provided by you. It is your responsibility to ensure this address is correct and secure.
6. Customs, Duties, and Taxes
- Client’s Responsibility: The Client is solely responsible for all import duties, customs fees, taxes (like VAT or GST), and brokerage fees levied by the destination country.
- Customs Clearance: We will provide all necessary export documentation from India (e.g., Invoice, Certificate of Origin). However, you are responsible for handling the customs clearance process in your country. We recommend you consult with a local customs broker.
7. Inspection and Acceptance
- Inspection Period: The Client has a period of [e.g., 48 hours] from the time of delivery to inspect the shipment.
- Notification of Discrepancies: Any discrepancies, such as damage to the parcel or incorrect items, must be reported to us in writing within this [e.g., 48-hour] period, accompanied by photographic evidence.
- Acceptance: If no notification is received within the specified period, the shipment will be deemed accepted by the Client.
8. Returns and Refunds
Due to the nature of B2B wholesale transactions and international shipping complexities, we generally do not accept returns or offer refunds once an order has been confirmed and shipped. Returns will only be considered in the rare event that the Product delivered is demonstrably different from the Product specified in the confirmed order. Any such claim must be made within the inspection period. The non-refundable advance payment will be forfeited in case of an order cancellation by the Client.
9. Authenticity and Certification
We guarantee the authenticity of all our Products. Gemstones can be provided with a certificate from a reputable gemmological laboratory upon request. The cost of certification is borne by the Client and will be included in the final invoice.
10. Limitation of Liability
To the fullest extent permitted by law, Abhashri Gems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your purchase or use of our Products. Our liability for any claim arising out of your purchase shall not exceed the amount you paid for the Product.
11. Governing Law and Dispute Resolution
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding shall be brought exclusively in the competent courts of Mumbai, Maharashtra, India.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of our Site and services after any such changes constitutes your acceptance of the new Terms.
